How to File for Divorce

If an individual seeks to dissolve their marriage, they will file a complaint for divorce with the district court. The other spouse will then respond via a counterclaim. If the other spouse fails to respond or agrees, the divorce will be uncontested. This process is referred to as a “joint petition” or “summary divorce” in Nevada. Couples can file a joint petition if they agree on asset allocation and parental rights. Nevada Revised Statute 125.181 details eligibility for filing a summary proceeding. 

Conversely, if one spouse determines issues to resolve, such as alimony or asset division, the divorce is considered contested. A judge will grant a dissolution of marriage if grounds for divorce exist. The court may also award alimony, determine child custody and support, and divide marital assets. In some cases, a judge may order one spouse to cover attorney fees related to the divorce proceedings.

Residency Requirements for Divorce

The county where couples reside is where they file for divorce, but for Nevada, at least one party must have been a resident for six weeks before filing. If the couple lives in different counties, they can choose either county to file for divorce. Filing for legal separation or establishing residency in Nevada can be an option if the residency requirements are not met.
